I am new at this.  Our community in Ocala is subject to mandatory fees for cable service from Cablevisionn of Marion County in violation of the new exclusivity law effective in 2008.  We are a MUD community and CoMC bills us directly.  The POA or declarant are not involved.  The discussions on bulk billing have passed us by.  How can we put pressure on the right party to resolve this.  Thanks.

When the contract was negociated? Is the contract exclusive or bulk billing? Can you contract another service provider?

The cable system was installed by the original developer of the community, in the early 80's.
At that time you were required to use his service as it was the only thing available.
The cable service has been sold at least 2 times in the past 15 years.
The present owner of the community has nothing to do with the cable service.
The present cable company continues to bill everyone individually whether they use their service or not.
We are allowed to have satellite service but must still pay Cablevision.

It seems that your community has an easement to grant Cablevison to provide telecom services to the community. Satellite providers doesn’t need easements, they are covered by OTARD rules. In the past the FCC prohibited to have EXCLUSIVE contract with major cable companies although this ruling didn’t apply to Private Cable operators (PCO) and satellite companies. The intention of the FCC was to extend that ruling to PCOs--everything is staled with the new administration. I hope they move forward as soon all the new commissioners are in place. But it seems that will be not enough for your community—maybe the contract is exclusive and bulk. The risk of having a lien against the property means that the initial contract was somewhere tied to the declaration and or by laws of the community. For that you will need to get copy of all the contracts in place and investigate how the HOA can put a lien against the owner property.

I want to encourage you and others to file comment to the FCC proceeding 07-51 and 09-158 http://fjallfoss.fcc.gov/prod/ecfs/comsrch_v2.cgi this is the only way we can try to get the attention of the FCC to provide us consumer protection. During this tough times it tragic that we can lose our home over a cable bill; this is just silly!

The fact that a company is extracting money from senior citizens is outrageous and should be penalized criminally. Here in Virginia Beach we got many military service members that are obligated to pay the $146 a month for cable services while they are deploy and away from home. Where is the government??? When we needed or they just out there to give away our money to corporations that had failed.
