After many years of waiting the FCC have made a decison on Bulk Billing http://hraunfoss.fcc.gov/edocs_public/attachmatch/FCC-10-35A1.pdf They will allow the practice-- the allegation is that bulk billing is good for consumers. You make that call! I will look foward for your comments

I'm finding it VERY hard to remain civil about this decision.  Perhaps, in the bigger picture, this helps lower income people.  In *my* world, this SUCKS!  We are now held hostage by our developer to raise rates and offer no significant discount.   As a matter of fact, we're paying MORE for our Brighthouse cable with our HOA than my co-workers do who live in non-HOA developments.

Thanks, Uncle Sam, looks like the lobbyists greased your palms and lined your pockets once again.   Angry

Taking-a-stand,

we might have had a chance if we could buy these lawyers as well. So much for Change!! In my book the FCC is as good as the SEC. SEC had Madoff and FCC has big telco.

Communities and consumers unite!  We will have to file a class action lawsuit to settle this issue.  The Second Report and Order filed by the FCC on the case of bulk billing is surreal.  This report is so bias and so filled with all the marketing spins from the industry that you would think that it was done-by-industry for FCC to file.  

First and foremost, the “significant discounted rate” they allude to only exists in the paperwork submitted by the cable industry.  Independent unbiased reports like the Consumers Union title: (I don’t know why) The Continuing Abuse of Market Power By The Cable Industry, subtitle: Rising Prices, Denial of Consumer Choice and Discriminatory Access to Content, clearly defined how the cable industry continue to increase prices.  On page 1 of the report they state “rates have risen and continue to rise almost three-times faster than inflation”.  So the first question is, what is a discount on an already inflated rate?

Second, the industry lobbyists were successful at reviving (no pun intended) the “Celebrex” argument.  Were they claim the benefit of bulk billing arrangements outweigh their harms. But just like the drug, the bulk deal is still a dangerous one that needs to be considered carefully. We know that communities that have long term bulk contracts are not attractive to other service providers. In their own cable industry report on Anticompetitive Practices By Incumbent Cable Operators (Small Cable vs. Big Cable) the National Association of Telecommunication Officers and Advisors wrote “An overbuilder can enter a community only if it has a reasonable prospect of meeting substantial market penetration targets.”  There is not substantial market penetration targets in MDU units tied to a perpetual or semi perpetual bulk agreement.  Further, back to our unbiased source from the Consumers Union, on page 7 they wrote “Bigger monopolies are worse when it comes to consumer prices”.   If you don’t have competition you prices will always be higher. Thanks to the FCC bulk billing communities will never have the burden of low prices.

I would like comment on the FCC Report  “ MVPD provider is spared the significant expense of selling to each resident, making credit checks and collecting deposit, managing bad debt and theft of service and frequently sending personnel and vehicles to the building to place and removed boxes and turn service on and off in different units.”  We replace that by placing the financial liability of the contract on the HOA and homeowners. Regular folks are still waiting for their bail-out while industry goes on being bailed out by our dollars.

As for the “lower prices” can someone please write me and let me know they are getting the promised discount?  On the Second Report of Order all the references about discounts are from the cable industry or their representatives. Again, the Consumers Union recognized on page 2 “the FCC failure to develop solid independent data may harm the consumer substantially.”  It already has.

Tenants that rent maybe surprise to know that FCC passed judgment on their credit rating, the FCC said: “these tenants also avoid high deposit and the limitations imposed by their own imperfect credit histories.”  Tenants that rent should call their congressman and express their discontent about and agency that pass judgment on their credit rating and their bulk billing arrangement without having any real independent data. While you are at it, ask for the FCC dissolution since the FCC is not doing anything for you and is only publishing elitist lobbyist comments.

Now to the “time to decide among competing MVPD, the cost of deposit, the taking a vacation day to let the installer in and charges for installation and disconnection of service.”   So not only do we have bad credit, we are incapable of making decisions and our wages are so meager that we would be unable to afford cable if miss a day work.  Thank you FCC for reliving me of this burden.  

The FCC is anti-consumer and pro industry.  Consumers can not count on government agencies to protect them.  If you are concerned about your well being, take action and become involved. The government eliminated the comprised between consumers and industry and now is either them or us.  Pick a side and do what you must do to ensure your survival.  All those in favor of a class action lawsuit please raise their hands. (Let me know)

To Zuriel, the Castros and all those who wrote to the FCC,

Thanks for all of your time and efforts.  It appears, though, that we were all very foolish to believe the FCC would help in any way since they are, after
all, a politically controlled organization ( more on that later ).

I believe we made a compelling case against bulk billing.  Time and time again
we shot down most of the industry's arguments.  We certainly stated numerous abuses and harms caused by bulk billing but to no avail.  Ar least we
tied up the industry lawyers and lobbyists by making them respond to our
letters.  And at least we wrote personal opinions and not the canned, talking
points and form letters sent in by apartment owners, colleges and condo
associations.

Unfortunately, for those communties like our counterparts in Virginia, until the
homeowners gain control of the HOA, it appears there is little that can be
done. With the current housing market, about the only way homeowners
can gain control is by the bankruptcy of the developer.  Oh there may be the
occasional TV-news segment or an article in the newspaper but until the
bulk billing industry ( developers, cable operators, apartment owners, condo
associations, telecoms, the FCC and politicians ) feel threatened by a high profile, multimillion dollar lawsuit, there will be no changes made.  And just
who will put up the multimillions it will take to finance such a class action
lawsuit?

Now to the real villian in this mess -- the FCC.  These appointed, all-knowing
gods of the media, are nothing but the stooges of the politicians who appointed them.  And who controls these politicians -- the same fat cat lobbyists, high priced lawyers, developers, cable operators, apartment owners,
condo associations and telecoms the FCC is supposed to be overseeing.  Any wonder they made the decision they did?  Not in my mind.

As long as we have the same current political system under the control of
BIG MONEY, there will be no REAL change for the GOOD on the PUBLIC.  The
only changes will be for the benefit of whoever the lobbyists represent -- those individuals and companies willing to buy a politician's vote.  And for
the majority of us trying to live in the "middle of the road" we have no
representation at all, since today's system only allows for "far left" and
"far right" opinions at both the federal and state levels.

I greet you from Florida in a community that now has a homeowner controlled
HOA that successfully ditched a bulk billing contract. Best of luck to those
especially in Virginia.  Maybe Sandler  will go belly up soon and you, the homeowners, can gain control and can tell Cox to take a flying leap also.

I'm ready to fight this thing 100%.  I've been out of town and not involved in the HOAs, but now have a bit more time to devote to overturning this nonsense.  Has the Lexington HOA even turned over yet?  You and I need to get on the Lexington HOA as soon as possible.  I intend to go to the next meeting and really mixing things up.  If Avalon can do this, so can we.  The HOA should be hiring an attorney -- they have a fiduciary duty to us, and I look forward to having a court force them to start honoring that duty.  I'd be willing to hire an attorney and suing Sandler and the HOA.

I'm ready to fight this thing 100%.  I've been out of town and not involved in the HOAs, but now have a bit more time to devote to overturning this nonsense.  Has the Lexington HOA even turned over yet?  You and I need to get on the Lexington HOA as soon as possible.  I intend to go to the next meeting and really mixing things up.  If Avalon can do this, so can we.  The HOA should be hiring an attorney -- they have a fiduciary duty to us, and I look forward to having a court force them to start honoring that duty.  I'd be willing to hire an attorney and suing Sandler and the HOA.
